Official Switch Out Contest Rules

Entry and Eligibility

This contest runs between 9 am EST January 1, 2010 and 9 am EST November 20th, 2010 (the "Contest Period"). Any participating business registered for the Switch Out program, that returns at least but not limited to, two pails containing automotive mercury switches during the contest period and returns a completed Switch Out 2010 Contest Ballot to the Switch Out coordinator shall be given one entry into the contest by the Switch Out program coordinator. Any business that also exceeds its 2009 collection results shall be given one additional entry ballot into the contest by the Switch Out coordinator. Branches of large companies shall be entered individually so long as that specific branch is registered as a Switch Out program participant and has complied with the rules of entry and eligibility. Each eligible entrant can receive up to a total of two entries into the contest. Eligibility for entry ballots shall be determined by reports from Switch Out employed storage units and results found in the Switch Out database "Footprints" that contains an accurate listing of all registered Switch Out program participants and the automotive mercury switch collection results of every participant. "Footprints" is a database system created by "Parachute Software", a third- party company. http://www.parachutesoftware.com

This contest is only open to businesses registered as participants in the Switch Out program, that operate in the Country of Canada, excluding the employees, directors and officers of the Summerhill Impact, and their immediate families, advertising and promotion agencies, related people (as defined in the Income Tax Act, Canada) and independent judging organizations (if any). The individual representing any business must be 18 years of age or older. A business may register for Switch Out and become eligible for the contest by returning two pails containing automotive mercury switches and returning a completed contest ballot at any time during the contest period. Odds of winning depend on the number of businesses that return two pails containing automotive mercury switches and returning completed collection ballots during the contest period and the amount of businesses that also collect more switches than they did in 2009 during the contest period.

A copy of the "Official Contest Rules" for this contest will be posted at www.switchout.ca throughout the contest period. The Organizers (Summerhill Impact) reserve the right, in their sole discretion, to disqualify any entrant that is found to be tampering with the entry process or with the operation of this contest, or to be acting in violation of the Official Contest Rules. The Promoters reserve the right, in their sole discretion, to amend, cancel, terminate or suspend this contest, in whole or in part, without prior notice, should any cause corrupt or affect the administration, security, fairness or proper conduct of this contest.

To win, a selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical, skill- testing question, to be administered by telephone at a mutually convenient time, or by mail. If reasonable efforts to contact a selected entrant and administer the skill-testing question are not successful, the selected entrant will be disqualified. All entries are subject to verification and will be declared invalid if they are late, lost, illegible, incomplete, forged, falsified, altered or tampered with in any way. The promoters are not responsible for contacting entrants who provide unclear or incomplete information and assumes no responsibility for entries that are lost, stolen, delayed, damaged or misdirected, nor for any failure of its web site or database for any reason during the Contest Period, including any failure to include a participant as a result of technical problems.

Any attempt to deliberately undermine the legitimate operation of this contest is a violation of law, and should such an attempt be made, the Promoters reserve the right, in their sole discretion, to exclude such person, from the contest and to seek remedies and damages to the fullest extent permitted by law.

PRIZES

The approximate value of each prize is subject to change over the contest period as more prize items are gained.

The prize must be accepted as described in these Official Contest Details and cannot be transferred to another individual, substituted for another prize or exchanged in whole or in part for monetary gain. Prizes and products awarded may not be exactly as shown. The Summerhill Impact reserves the right to substitute alternate prizes of approximately the same value and which serve a similar function. Prizes must be accepted as awarded and are not convertible to cash and are not transferable or assignable. In the case of the grand prize or secondary prizes, prizes will be awarded only to qualifying entrants.

Delivery of prizes may require that the winner demonstrate to the Summerhill Impact and/ or to the supplier of the prize that there is a safe and appropriate location for installation of the prize (if applicable) and that arrangements satisfactory to the Summerhill Impact and/or the supplier of the prize to install the prize, at the prize winner's expense, have been made.

SELECTION PROCESS

The contest begins at 9 am EST, January 1, 2010 and ends at 9 am EST, November 20th, 2010. Any mercury collection pails must have been received by an official Switch Out storage unit, as marked on the participant's provided, pre-printed waybill, before the end of the contest period in order to qualify the participating business for a contest entry ballot. The winner shall be selected at random on November 20th, 2010 after the contest period ends.

The contest is only open to businesses of Canada who have an employee who has reached the age of majority in Canada. The odds of winning are dependant upon the number of entries submitted.

The eligible entrant will be notified by phone or by email November 20, 2010. The selected entrant must respond to the Switch Out Program Coordinator via phone at (416) 922-2448 or email within five (5) days of such notification or they will forfeit the prize. This selection process will continue until an eligible entry is selected and a winner is declared for the above prize.

In order to be declared an official winner, the selected entrant must:

  1. Respond to the notice that they have been selected as a potential winner within 5 days of notice;
  2. Confirm that they wish to receive the prize that they have been selected to win;
  3. Correctly answer, unaided, a time-limited, mathematical skill-testing question by email, fax, or telephone to Program Coordinator of the Switch Out program.
  4. Provide satisfactory identification and proof of eligibility; and
  5. Sign and return to the Program Coordinator of the Switch Out program, within one (1) week of receipt thereof, an agreement and release confirming the entrant's eligibility and compliance with the Official Contest Rules, acceptance of the prize as awarded, and releasing the Promoters and their advertising and promotional agencies and their respective affiliates, directors, officers, employees and agents, and successors and assigns (the "Releases") from all liability for damages s/he may incur as a result of participating in this contest and accepting and using the prize.

Failure to comply with these rules will cause the prize to be forfeited, in which case, the prize will be re-awarded at the Promoter's discretion.

All decisions of the contest judge will be final and binding on entrants, without right of appeal. No correspondence will be entered into except with the successful entrant.

RELEASE

By participating in this contest, entrants agree to be bound by these rules and all decisions of Summerhill Impact. Winners release Summerhill Impact, the prize suppliers, and their respective officers, directors, employees and agents from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any prize and acknowledge that Summerhill Impact, its officers, directors, employees and agents has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied in fact or in law, including but not limited to its quality, mechanical condition or fitness for a particular purpose.

By claiming a prize, prize claimants consent to the use of their name and/ or photograph, without compensation in any publicity carried out by Summerhill Impact or any prize supplier.

GOVERNING LAWS

This promotion is subject to all applicable laws of Canada applicable therein.

PERSONAL INFORMATION

No personal information shall be gathered about entrants for the purposes of this contest beyond the information collected for the purposes of registering as a Switch Out participant. All entrants must be fully registered for the Switch Out program and must have returned at least two Switch Out collection pails containing automotive mercury switches and a completed contest ballot to be entered.

Contest participants understand and consent that their responses on completed and returned contest ballots will be used for the sole purpose of research, program development, statistical record keeping, organizational updates and program promotion.

Businesses may be asked to provide information that will serve as content for the profile articles that may be offered as prizes. Any information provided by the winner may be used as content by the party writing the feature article. The winner reserves the right to check any written article for accuracy pertaining only to their business. The Summerhill Impact, Canadian Auto Recyclers, Collision Repair magazine and any subsidiaries reserve the right to create and publish content as per the standards of their publications.
